1. Introduction

These Terms and Conditions of Purchase and Use (hereinafter “Terms and Conditions of Purchase”) for the website www.luzdealba.es (hereinafter “the Site”) apply to all transactions carried out on the website owned by the company LUZ DE ALBA. The legal information of LUZ DE ALBA, pursuant to the provisions set forth in Law 34/2002 of 11 June on information society services and electronic commerce (LSSI), can be found in the “Legal Notice” section, which is accessible from all pages on the Site.

By accessing and using the Site, you acknowledge that you have read, understood and agree to the Terms and Conditions of Purchase. To purchase items on the Site, users must agree to these Terms and Conditions of Purchase.

LUZ DE ALBA may modify or update all or part of the Terms and Conditions of Purchase, taking into account any changes to existing legislation and regulations. Each new version of the Terms and Conditions of Purchase shall be effective from the date it is published on the Site. Please review the Terms and Conditions of Purchase every so often. If you do not agree to any changes to the Terms and Conditions of Purchase, please do not use the Site.

When you acquire products from the Site, you will be asked for certain personal information that must be true, accurate, current and complete in all respects (see the Legal Notice and Privacy Policy).

The customer is solely and exclusively responsible for the use of the Site and its content. LUZ DE ALBA cannot be held responsible for any use of the website that is contrary to the legislation and regulations in force. In case we detect any illegal activities or violations of these Terms and Conditions of Purchase, we reserve the right to deny you access to the Site or any part thereof without notice.

LUZ DE ALBA sells its products on the Site only to end consumers. End consumers are natural persons who make purchases on the Site for purposes other than for business, commercial or professional activities. To receive information (catalogue and prices) on purchasing products designed and manufactured by LUZ DE ALBA wholesale, you may contact us by sending an e-mail to info@luzdealba.es or by calling +34 926 972 940 from 9 a.m. to 6:00 p.m., Monday to Friday.

LUZ DE ALBA reserves the right to modify its product offering at any time by means of its publication on the Site (modifications on prices, products, promotions, and other commercial and service terms and conditions). Under no circumstances shall these modifications affect purchases that have already been made.

2. Prices

The prices that appear on the Site for the purchase of olive oil and other products for EU countries are already inclusive of the VAT that is applicable, which means that there are no additional surcharges aside from delivery charges (where applicable).

For countries outside the European Union or in the Canary Islands, Ceuta or Melilla, upon receiving your purchase, it is possible that you may have to pay additional taxes and customs duties. You can contact the customs offices in your country to request detailed information regarding these fees.

 

3. How to Make a Purchase

To make a purchase, add the products you want to your basket (by clicking on the “Add to Basket” button under each product information), and once you are done, click on the basket icon that will drop down the right-hand side and click “Checkout”. Afterwards, all you have to do is fill in the fields in the form and accept these Terms and Conditions of Purchase and our Privacy Policy. Lastly, you should confirm the order by clicking on the “Confirm” button.

You will be able to access the Terms and Conditions of Purchase, the price and description of the selected products and the delivery charges and times from the product information screens.

The contract with Luz de Alba is accepted when we receive your order online and once we have checked the veracity of all information. Before sending your order, you will be asked to read and accept the Terms and Conditions of Purchase and Privacy Policy and to confirm that the information you have provided to us is correct.

After your order is sent online, a screen will appear showing the order number and that the order has been completed. We advise you to print out this screen in case you do not get the e-mail that we automatically send to inform you of the confirmation of your order and its number.

Luz de Alba may refrain from accepting orders with no assurance of solvency, that are incomplete or that are for unavailable products. In any of these cases, you will be informed by e-mail that the contract has not been accepted, informing you of the reasons why it could not be performed.

When you formalise your purchase in the way that we have described, you are accepting the Terms and Conditions of Purchase, the Privacy Policy, the return and exchange policy and all of the Site’s content. Please remember that we can answer any queries and provide assistance through info@luzdealba.es or at the number + 34 926 972 940 from 9:00 a.m. to 6:00 p.m., Monday to Friday. Each product’s characteristics are shown in the product information on the Site. The products offered on the Site may not match the actual details of the products as the images of the products can appear different depending on the monitor or browser used.

4. Purchase and Payment Methods

You can choose among different purchase and payment methods with Luz de Alba, depending on your preferences; all of them offer the highest security guarantees:

4.1 .Purchasing through the Site

  • Card payment (debit or credit) using our secure payment gateway from Banco Santander, which will connect you to your bank. Payment details, handled and processed securely, will always be encrypted and will never be stored or shared with third parties for any purpose other than payment for the transaction. Luz de Alba will never have access to debit or credit card information.
  • Payment by bank transfer to the account number that we provide upon choosing this option at checkout. Please bear in mind that when paying by wire transfer, we will not be able to send you your order until the total purchase amount has been deposited to our bank account, which means that the estimated delivery time is counted from that moment on (usually one or two days more).
  • Payment using PayPal (www.paypal.com), a system that lets you pay securely on the Internet using an existing PayPal account, or by simply entering your credit or debit card information.
  • Cash on delivery. If you wish to pay when you receive your order at home, you should know that:
  • There is an additional charge for choosing this option due to management fees (aside from delivery charges) which equals 3% of the purchase amount, with a minimum of €2.

When your order is delivered, you should have the exact amount ready to pay the courier in cash.

4.2 Purchasing over the phone

If it is easier for you to call and talk to us to tell us your order, you can do so by calling +34 926 972 940 from 9:00 a.m. to 6:00 p.m., Monday to Friday. Simply tell us which item(s) you want and we will give you our account number so that you can make a bank transfer for the purchase amount (plus delivery charges, where applicable). When purchasing over the phone, you can also pay via cash on delivery, but not by card or using Paypal.

5. Delivery Method and Charges

All orders are shipped through courier companies that we work with. You can check delivery times and courier prices in the “Delivery Times and Charges” section.
In case the customer is not present at the delivery address indicated when a delivery attempt is made, the courier company will leave a notice (attempted delivery notice) in the mailbox so that the customer can contact them and agree on the most convenient time for delivery. In any case, the courier company will make a maximum of two delivery attempts. After two unsuccessful delivery attempts, the order will be returned to Luz de Alba, and the customer will have to pay delivery charges again if they want to arrange for a new delivery.
The customer undertakes to enable delivery by providing an address where the order can be delivered, within standard business hours (Monday to Friday, from 9:00 a.m. to 6:00 p.m.). The customer must likewise provide their phone number (it is advisable to provide a mobile phone number) in the relevant field upon completing their purchase, so that the courier company can contact them in case there was nobody at the delivery address to receive the parcel. In the event of the customer’s failure to comply with these obligations, Luz de Alba shall not be liable for any delay or failure in delivering the order requested by the customer.

7. Withdrawal (Return) and Exchange Policy

If, for you any reason, you are not completely satisfied with your purchase, you can exercise your right of withdrawal (return) or exchange within 15 working days from the date when you received the order.
To return or exchange an order, you have to send an e-mail to info@luzdealba.es within those 15 working days, and in less than twenty-four hours, we will send you a reminder of the steps to follow, as specified below:
Luz de Alba will send a courier to collect the parcel with the item(s) to be returned/exchanged. The right of withdrawal (return) and exchange of purchases is subject to the following conditions:
* Products must be returned intact; they cannot be used or damaged.
* Products must have the Luz de Alba brand label, which must be attached to the item (if it was originally attached).
* Products from the same order must be returned in a single shipment; returns from the same order will not be accepted separately.
Luz de Alba will check the condition of the item(s) and send you a response within a maximum of 15 working days from the date when they were collected.
In the event of a request for a refund, one of the following circumstances may arise:

  1. That the product does not meet the previously mentioned conditions, and as a result, its return is rejected by Luz de Alba,. In this case, we will contact the customer and offer to return (cash on delivery) the items that were not accepted by Luz de Alba. All expenses incurred for this return, including shipping for these items (from the customer to Luz de Alba, and vice-versa), taxes or customs duties, if any, will be at the customer’s expense. If the customer does not accept the option of keeping the product that was returned to Luz de Alba and rejected by it, the latter may keep the items and the amount thereof.
  2. That the product meets the previously mentioned conditions, and as a result, its return is accepted by Luz de Alba,. In this case, the customer will receive an e-mail informing them the return has been accepted and that the purchase amount will be refunded to the customer within a maximum of 30 working days, including VAT and excluding delivery charges for customers within the European Union. For customers from countries outside the European Union, the purchase amount will be refunded in the same manner, excluding customs duties arising from the return and delivery charges.
    Delivery charges will be refunded in case the customer exercises their right to return goods due to reasons attributable to Luz de Alba (e.g., wrong product sent by Luz de Alba, defective product, etc.).
    In the event of a request to exchange the purchased item which has been accepted in accordance with the aforementioned conditions, Luz de Alba will send a courier back to the customer with the new item,
    replacing the item that was previously collected, with cash on delivery for the shipping costs incurred (from the customer to Luz de Alba, and vice-versa).

8. Delivery Times and Costs

Delivery times vary (depending on the type of delivery and destination).
Generally speaking, for the products that we have in stock in our warehouses (which are the majority): from 3 to 10 days.
If the product is not currently in STOCK, its estimated delivery time (which in this case will take longer) will appear on the product information in our online shop.
For international deliveries or deliveries to the Canary Islands or Ceuta and Melilla, delivery times within Spain must be added to delivery times to your country of destination.

9.Delivery Costs

Delivery costs for Spain (Peninsular Spain and the Balearic Islands) will vary depending on the weight and volume of the products comprising the shipment. Please bear in mind that delivery costs are free for orders with an amount greater than or equal to €60.
Customs duties arising from deliveries to these autonomous communities or cities (the Canary Islands, Ceuta and Melilla), as well as local taxes such as the Canary Island General Indirect Tax (IGIC), will be at the buyer’s expense.
For international deliveries, you can see the actual delivery costs by simply filling in the “Country” field during the purchase process.

As mentioned before, delivery costs for orders with an amount greater than or equal to €60 will be sent free of charge within Spain (except to the Canary Islands, Ceuta and Melilla).

Cancelling or Modifying Bookings

Cancelling

Upon making a booking at Finca Luz de Alba, the customer agrees to its cancellation and no-show policies.

A credit card is required to make a booking.

In low season

The cost of the first night will be charged in case the booking is cancelled less than two days before arrival in low season.

In high season

The cost of the first night will be charged in case the booking is cancelled less than de 7 days before arrival.
50% of the total booking amount will be charged in case the booking is cancelled less than de 3 days before arrival.
Cancelling on the day of arrival or not showing up will incur 100% of the total booking amount as a cancellation fee.

Unexpected or early departure

100% of the total booking amount will be charged in case of unexpected or early departure, giving notice the day before departure.

If it were for more days, 50% of the booked stay will be charged.

Modifying bookings

Upon making a booking at Finca Luz de Alba, the customer agrees to its cancellation and no-show policies.

A credit card is required to make a booking.
